1. Made-to-Order Production
All items sold by ByNickScacchetti are made to order. This means each piece is produced specifically for you once your order is placed. Because of this:

We do not offer returns, refunds, or exchanges except as expressly stated in this policy.

Please review size charts, product descriptions, and all details carefully before placing your order.
2. Order Changes & Cancellations

Orders may be cancelled or modified within 6 days of purchase.

After 6 days, production will have begun, and no cancellations or modifications will be accepted.
3. Defective, Damaged, or Incorrect Items
We take quality seriously. If your order arrives damaged, defective, or incorrect:

Contact us within 7 days of delivery at ByNickScacchetti@gmail.com with your order number and clear photos of the issue.

We will, at our discretion, repair, replace, or refund the item at no cost to you.

Items must be in their original, unworn, unwashed condition to be eligible for replacement or refund.
4. Lost Packages

If a package is confirmed lost in transit by the shipping carrier, we will issue a refund or replacement at no additional cost to you.

Please allow the carrier’s investigation to conclude before a resolution is processed.
5. Non-Returnable Items
For hygiene and quality control reasons, the following items are final sale and cannot be returned or exchanged:

Worn or washed garments

Custom or personalized pieces

Items returned without prior approval
6. Refunds (If Applicable)
If a refund is approved:

Refunds are processed back to your original payment method.

Depending on your payment provider, funds may take 5–10 business days to appear.
7. No Chargebacks
By purchasing from ByNickScacchetti, you agree to first contact us directly to resolve any issue before initiating a dispute or chargeback with your bank or payment provider.

Any chargeback initiated without first giving us the opportunity to resolve the issue will be considered a breach of this agreement.

We reserve the right to contest and recover all costs associated with unjustified chargebacks.
8. Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to your purchase, these terms, or the breach thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Arbitration shall take place in the state of Ohio, United States.

Each party shall bear its own costs, and the decision of the arbitrator shall be final and binding.

You waive any right to a jury trial or to participate in a class action.
9. International Orders

We are not responsible for any customs duties, import taxes, or delays caused by international shipping processes.

International orders follow the same made-to-order and final sale terms as domestic orders.
